You obviously misunderstand the First Amendment. The First Amendment only protects you from the Government. Not from people that disagree with you. Just ask the Dixie Chicks about their album sales after bashing Bush...

You're probably both right. Freedom of speech is also a fundamental right in our constitution (Germany). It's protection from Gov but there's a so called "indirect third-party effect" between citizens. Same in the USA I guess...
